Terms of Sale — Casa Poerava

These terms of sale are entered into, on the one hand, by Casa Poerava, operated by the sole trader (entrepreneur individuel) Sophie-Fleur Blanchard, whose registered office is located in Grosseto-Prugna, registered with the Ajaccio Trade and Companies Register (RCS) under number 791918477, hereinafter referred to as "Casa Poerava," which operates the website casapoerava.com, and, on the other hand, by any natural or legal person wishing to make a purchase through the website casapoerava.com/shop, hereinafter referred to as "the buyer."

Article 1. Purpose

These terms of sale are intended to define the contractual relationship between Casa Poerava and the buyer, and the terms applicable to any purchase made through the website casapoerava.com/shop. The purchase of a product through this website implies the buyer's unreserved acceptance of these terms of sale, which the buyer acknowledges having read prior to placing the order. Before any transaction, the buyer declares, on the one hand, that the purchase of products on the website casapoerava.com/shop is unrelated to their professional activity and is limited to strictly personal use and, on the other hand, that they have full legal capacity to enter into these general terms of sale.

Casa Poerava reserves the right to modify these terms of sale at any time, in order to comply with any new regulations or to improve the use of its website. Consequently, the applicable terms shall be those in force on the date the order is placed by the buyer.

Article 2. Products

The products offered are those appearing on the website casapoerava.com/shop of Casa Poerava, subject to available stock. Casa Poerava reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description setting out its main technical characteristics (capacity, use, composition, format, etc.). The photographs are as accurate as possible but are not binding on the Seller. The sale of the products presented on the website casapoerava.com/shop is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

Article 3. Prices

The prices shown on the product pages of the online catalogue are in Euros (€), inclusive of all taxes (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be passed on to the price of the products. Casa Poerava reserves the right to modify its prices at any time, it being understood, however, that the price shown in the catalogue on the day of the order shall be the only price applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased according to the total amount of the order. In metropolitan France, for any order greater than or equal to €1 (incl. tax), shipping is free; for any order below €0 (incl. tax), a flat-rate shipping contribution of €0 (incl. tax) will be invoiced to the buyer.

Article 4. Ordering and payment terms

Before placing any order, the buyer must create an account on the website casapoerava.com/shop. The account creation section is accessible directly from the side menu bar. On each visit, the buyer, if they wish to order or consult their account (order status, profile, etc.), must log in using this information. Casa Poerava allows the buyer to order and pay for their products in several steps, with 3 payment options to choose from:

• Payment by cheque: the buyer selects the products they wish to order in the "basket," makes changes if necessary (quantities, references, etc.), verifies the delivery address or enters a new one. The shipping charges are then calculated and presented to the buyer, along with the name of the carrier. The buyer then chooses their preferred payment method: "Payment by cheque." Finally, the last step invites them to check all the information, read and accept these general terms of sale by ticking the corresponding box, and then to validate their order by clicking the "Confirm my order" button. This final click constitutes the definitive conclusion of the contract. Upon validation, the buyer receives an order confirmation acknowledging the registration of their order. In order to finalize payment and trigger the processing of their order, the buyer must print this order confirmation and send it, together with their cheque made payable to "Casa Poerava," to the following address: Casa Poerava, Sophie-Fleur Blanchard, La Rocade de Porticcio, Scaglione, 20166 Grosseto-Prugna. No cash payment should be sent. Only cheques issued by a French bank will be accepted. Upon receipt of the cheque, the order will be processed and the buyer will be notified by email. Casa Poerava will ship the products no earlier than 2 business days after the cheque corresponding to the order has cleared, subject to sufficient funds.

• Payment by bank transfer: the buyer selects the products they wish to order in the "basket," makes changes if necessary (quantities, references, etc.), verifies the delivery address or enters a new one. The shipping charges are then calculated and presented to the buyer, along with the name of the carrier. The buyer then chooses their preferred payment method: "Payment by transfer." Finally, the last step invites them to check all the information, read and accept these general terms of sale by ticking the corresponding box, and then to validate their order by clicking the "Confirm my order" button. This final click constitutes the definitive conclusion of the contract. Upon validation, the buyer receives an order confirmation acknowledging the registration of their order. In order to finalize payment and trigger the processing of their order, the buyer must contact their bank to make the transfer corresponding to the amount of their order to the Casa Poerava bank account, the details of which are communicated to the buyer. Upon receipt of the transfer, the order will be processed and the buyer will be notified by email. Casa Poerava will ship the products no earlier than 2 business days after receipt of the transfer corresponding to the order, subject to sufficient funds.

• Secure payment by PayPal or bank card (via the STRIPE system): the buyer selects the products they wish to order in the "basket," makes changes if necessary (quantities, references, etc.), verifies the delivery address or enters a new one. The shipping charges are then calculated and presented to the buyer, along with the name of the carrier. The buyer then chooses their preferred payment method. The next step invites them to check all the information, read and accept these general terms of sale by ticking the corresponding box, and then to validate their order by clicking the "Confirm my order" button. Finally, the buyer is redirected to the chosen secure interface in order to enter, in complete security, their PayPal or Stripe account details or personal bank card number. If the payment is accepted, the order is registered and the contract definitively formed. Payment by PayPal account, Stripe, or bank card is irrevocable. In the event of fraudulent use of the card, the buyer may request cancellation of the card payment; the sums paid will then be re-credited or refunded. The holder of a bank card is not liable if the disputed payment is proven to have been made fraudulently, remotely, without physical use of the card. To obtain a refund of the fraudulent debit and any bank charges the transaction may have generated, the cardholder must dispute the debit, in writing, with their bank, within 70 days of the transaction, or even 120 days if the contract binding them to the bank so provides. The amounts debited are refunded by the bank within a maximum of one month after receipt of the written dispute made by the cardholder. No fee for returning the sums may be charged to the holder.

Confirmation of an order entails acceptance of these terms of sale, acknowledgement of having full knowledge of them, and waiver of the right to rely on the buyer's own purchasing terms. All the data provided and the recorded confirmation shall serve as proof of the transaction. If the buyer has an email address and has entered it on their order form, Casa Poerava will send them confirmation of the registration of their order by email.

Article 5. Retention of title

Casa Poerava retains full and complete ownership of the products sold until the price has been paid in full, including principal, charges, and taxes.

Article 6. Right of withdrawal

Pursuant to Article L121-20 of the French Consumer Code, the buyer has a period of fourteen business days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, with the exception of return shipping costs.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which may only be within the agreed geographical area. Orders are fulfilled by La Poste via COLISSIMO, a tracked delivery service with delivery without signature. Delivery times are given for information only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer refunded. Casa Poerava may provide the buyer by email with the tracking number of their parcel. The buyer is delivered to their home by their postal carrier. In the event of the buyer's absence, they will receive a delivery notice from their carrier, allowing them to collect the ordered products from the nearest Post Office within a period indicated by the postal services. The risks associated with transport are borne by the buyer from the moment the items leave the premises of Casa Poerava. The buyer is required to check, in the presence of the La Poste employee or the delivery person, the condition of the packaging of the goods and its contents upon delivery. In the event of damage during transport, any complaint must be made to the carrier within three days of delivery.

Article 8. Warranty

All products supplied by Casa Poerava benefit from the legal warranty provided for in Articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned to Casa Poerava, which will take it back, exchange it, or refund it. All claims, requests for exchange, or refund must be made by post to the following address: Casa Poerava, Sophie-Fleur Blanchard, La Rocade de Porticcio, Scaglione, 20166 Grosseto-Prugna, within 15 days of delivery.

Article 9. Liability

In the distance selling process, Casa Poerava is bound only by an obligation of means (best-efforts obligation). Its liability cannot be engaged for any damage resulting from the use of the Internet network, such as loss of data, intrusion, virus, service interruption, or other involuntary problems.

Article 10. Intellectual property

All elements of the website casapoerava.com/shop are and remain the exclusive intellectual property of Casa Poerava. No one is authorized to reproduce, exploit, or use in any way whatsoever, even partially, any elements of the site, whether in the form of photos, logos, visuals, or text.

Article 11. Personal data

Casa Poerava undertakes to preserve the confidentiality of the information provided by the buyer, which they may be required to transmit for the use of certain services. Any information concerning them is subject to the provisions of Law No. 78-17 of 6 January 1978. In this respect, the user has a right of access to, modification of, and deletion of information concerning them. Article 12. Dispute resolution

These distance selling terms are subject to French law. For all disputes or litigation, the competent court shall be that of Ajaccio.
